The proposed Gold Coast Arena was marketed as a 12,000-seat crown jewel for the 2032 Olympics. But as the project moves forward, a war of words has erupted that shifts the story from urban planning into the dangerous territory of criminal allegations and potential defamation.

At the center of the storm is a three-page letter served this week by Don Magin, Olly Randall, and Dawn Crichlow OAM. The campaign, amplified via the Save Carey Park Gold Coast group, relies on legal theories that have been systematically dismantled by the High Court of Australia.


1. The "Corrupt Conduct" Misconception

The group’s attempt to brand the project as "corrupt" fails the Cunneen Test. In ICAC v Cunneen [2015] HCA 14, the High Court ruled that "corrupt conduct" must involve an attack on the probity (honesty) of an official, not just a disagreement with the efficacy or outcome of their decisions. Without evidence of criminal dishonesty, these public accusations of "corruption" are legally baseless.

2. The High Court "Dead End" on Consumer Law

The group alleges a breach of the Australian Consumer Law. However, Concrete Constructions (NSW) Pty Ltd v Nelson (1990) established that statutory planning functions are not "in trade or commerce." The HCA made it clear that "the mere... construction of a building" does not trigger consumer protection laws. The Council is not a commercial trader in this capacity.

3. The 1966 "Time Capsule" vs. 2026 Law

Under Section 53DFF of the Brisbane Olympic and Paralympic Games Arrangements Act 2021, the State has the explicit power to cancel all previous interests (including the 1966 lease) without compensation (Section 53DFG). In the legal hierarchy, a 2021 Act of Parliament specifically addressing Olympic infrastructure overrides historical lease agreements.

4. The "Handbag" Blunder

A significant blow to the group's credibility occurred when an attempt to report the Premier for "corrupt conduct" via social media accidentally tagged "CCC Shoe Bags"—a boutique handbag store—instead of the Crime and Corruption Commission. This underscores a critical lack of due diligence in making serious criminal allegations.

5. The Risk of Section 216

Making criminal accusations is high-stakes. Under Section 216 of the Crime and Corruption Act 2001, it is a criminal offense to knowingly make a false complaint to the CCC. Furthermore, public claims of corruption without proof of dishonesty fall squarely within the realm of actionable defamation.

The Verdict

Southport deserves serious discussions about its future, but using debunked legal and conspiracy theories to accuse public officials of crimes is a dangerous game. While current representatives like Cr Brooke Patterson continue to operate with professional diligence and a focus on the facts, former Councillor and 29-year veteran Dawn Crichlow OAM has taken a disappointing post-career turn.


It is also noteworthy that Crichlow is the sister-in-law of Samantha Delmege, who unsuccessfully challenged Cr Patterson for the Division 6 seat in the last local government election. This familial link casts a shadow over the "Save Carey Park" campaign, suggesting it may be fueled as much by lingering political friction as by genuine civic concern. By lending her name and OAM to flawed legal logic and "handbag" reporting, Crichlow risks tarnishing a decades-long legacy. Southport expects its former leaders to uphold the same standard of integrity and evidence-based leadership currently shown in the Council chambers, rather than promoting "sovereign citizen" style theories that have no standing in the High Court.
